TERMS OF SERVICE
Welcome to INDIE X FM.
These Terms of Service (“Terms”) apply to your access to and use of the INDIE X FM website, audio streams, music submission services, merchandise pages, and other services provided through indiexfm.com (collectively, the “Services”).
By accessing or using the Services, you acknowledge that you have read, understood, and agree to these Terms. If you do not agree to these Terms, please do not use the Services.
1. ABOUT INDIE X FM
INDIE X FM is an independent, non-commercial online radio station operated without a profit motive, dedicated to supporting independent music, artists, bands, DJs, and the independent music community.
INDIE X FM is privately funded and maintained at the expense of its operators. The station does not generate income from advertising, commercial sponsorships, or merchandise sales. We operate INDIE X FM because of our passion for independent music and our commitment to providing an alternative to commercially driven radio.
INDIE X FM operates without advertising or commercial advertising interruptions. Our programming is focused on the music, artists, DJs, and listeners that make up the independent music community.
INDIE X FM also offers station merchandise through a third-party merchandise platform. INDIE X FM does not make a profit from the sale of its merchandise. Merchandise is made available for listeners and supporters who would like INDIE X FM-branded items.
INDIE X FM features independent music, artist and band programming, DJs, specialty shows, guest programs, and syndicated programming.
INDIE X FM provides its Services primarily for personal listening and entertainment.
No listener account or registration is required to listen to INDIE X FM.
INDIE X FM reserves the right to modify, suspend, restrict, or discontinue any portion of the Services at any time.
2. STREAMING ACCESS
INDIE X FM provides audio streams for personal listening through supported devices, players, applications, and other approved listening methods.
The INDIE X FM stream is intended to be accessed through normal streaming methods.
You may not use software, services, scripts, automated systems, or other methods designed to capture, copy, record, redistribute, mirror, rebroadcast, extract, or otherwise interfere with the INDIE X FM stream.
Stream Ripping
Stream ripping is strictly prohibited.
This includes, but is not limited to:
INDIE X FM may immediately disconnect and/or block access associated with activity involving stream ripping.
An IP address associated with stream-ripping activity may be permanently or indefinitely blocked from accessing INDIE X FM.
3. BOTS AND AUTOMATED ACCESS
The use of bots, automated listeners, scripts, crawlers, automated reconnect systems, or other automated methods to access the INDIE X FM stream is prohibited unless expressly authorized by INDIE X FM.
Prohibited activity includes systems designed to:
INDIE X FM may disconnect, restrict, or block IP addresses associated with bot activity or other unauthorized automated access.
4. EIGHT-HOUR CONTINUOUS LISTENING LIMIT
To help protect streaming resources and ensure that the INDIE X FM stream remains available to listeners, individual continuous listening sessions are limited to eight (8) hours.
After eight continuous hours of listening, a listener may be automatically disconnected from the stream.
This limit is intended to prevent continuous, unattended, or automated connections from occupying streaming resources indefinitely.
Reconnection After the Eight-Hour Limit
After being disconnected for reaching the eight-hour listening limit, listeners must wait at least ten (10) minutes before reconnecting.
If a listener's connection automatically reconnects or is manually reconnected within ten (10) minutes after being disconnected for reaching the eight-hour limit, INDIE X FM may consider the activity an attempt to circumvent the listening limit.
In such circumstances, INDIE X FM may block the associated IP address from accessing the stream.
Automatic reconnection within the ten-minute period is also prohibited.
5. IP ADDRESS RESTRICTIONS AND BANS
INDIE X FM may use IP address restrictions and blocking to protect its streaming infrastructure and enforce these Terms.
An IP address may be blocked for activity including, but not limited to:
IP restrictions may be temporary, indefinite, or permanent at the discretion of INDIE X FM.
Because IP addresses can be shared by multiple people or devices, an IP restriction may affect other users accessing the Services through the same network.
INDIE X FM is not required to provide advance notice before disconnecting or blocking access.
6. SPECIALTY, GUEST, DJ, AND SYNDICATED PROGRAMMING
INDIE X FM broadcasts a variety of programming, including station-produced programming, specialty shows, guest programs, DJ-hosted programs, and syndicated programming produced by individuals or organizations other than INDIE X FM.
The opinions, statements, commentary, discussions, views, music selections, and other content expressed or presented during specialty, guest, DJ-hosted, or syndicated programs belong to the respective DJ, host, guest, producer, syndicator, or program provider.
Such content does not necessarily represent the views, opinions, positions, or policies of INDIE X FM.
The inclusion of a program, DJ, host, artist, guest, or syndicated show in the INDIE X FM programming lineup does not necessarily mean that INDIE X FM endorses or agrees with the opinions, statements, commentary, or other content presented during that program.
INDIE X FM does not assume responsibility for the opinions, statements, commentary, conduct, or content of individual DJs, hosts, guests, specialty programs, or syndicated programs broadcast through the INDIE X FM platform.
INDIE X FM reserves the right to select, schedule, modify, suspend, replace, or discontinue any program, DJ, host, or programming relationship at any time.
7. MUSIC AND BAND SUBMISSIONS
INDIE X FM accepts music submissions from independent artists and bands for consideration for airplay.
Submissions are accepted only from artists and bands whose music falls within the genres and musical formats currently played by INDIE X FM.
Submitting music to INDIE X FM does not guarantee:
INDIE X FM determines, at its discretion, whether a submission fits the station's musical format and whether the submission will be considered for airplay.
INDIE X FM may decline, remove, or discontinue consideration of any submission at any time.
By submitting music to INDIE X FM, the submitting artist, band, label, manager, representative, or other submitter represents that they have the necessary authority to submit the material to INDIE X FM for consideration.
8.MERCHANDISE
INDIE X FM may offer official station merchandise through its website.
INDIE X FM's merchandise store is operated through Bonfire.
INDIE X FM does not make a profit from merchandise sales. Merchandise is made available to listeners and supporters who wish to purchase INDIE X FM-branded products.
Merchandise purchases made through the INDIE X FM merchandise page are subject to both these INDIE X FM Terms of Service and the applicable Bonfire Terms & Conditions, policies, and requirements.
By purchasing merchandise through the INDIE X FM merchandise store, you acknowledge that you are also agreeing to the terms applicable to your transaction with Bonfire.

Bonfire operates the applicable merchandise purchasing, payment, fulfillment, shipping, and related merchant services. INDIE X FM does not independently process merchandise payments or fulfill merchandise orders.
Questions or issues concerning an order, payment, shipment, fulfillment, returns, refunds, or other transaction-related matters may be subject to Bonfire's policies and procedures.
Merchandise availability, product descriptions, pricing, and other information may change at any time.
8. CONTACT FORM AND INFORMATION SUBMITTED
The INDIE X FM website may provide a “Contact Us” form that asks users to provide information such as their name, email address, location, and the contents of their message.
This information is requested solely for the purpose of allowing INDIE X FM to receive and respond to inquiries.
INDIE X FM does not sell, rent, trade, or otherwise provide information submitted through the Contact Us form to third parties for marketing or commercial purposes.
INDIE X FM has no desire or intention to use information submitted through the Contact Us form for advertising, marketing, mailing lists, or other promotional purposes.
INDIE X FM does not maintain a database or user account system containing information submitted through the Contact Us form.
Information submitted through the form is generally deleted after the inquiry has been received and addressed, unless there is a specific reason to temporarily retain it in order to respond to or resolve the inquiry.
By submitting information through the Contact Us form, you understand that the information you provide may be transmitted to INDIE X FM for the limited purpose of receiving and responding to your message.
Please do not submit sensitive, confidential, financial, password, or other information that is not necessary for your inquiry.
10. PROHIBITED ACTIVITIES
When using the Services, you agree not to:
INDIE X FM may take reasonable technical action necessary to prevent or respond to prohibited activity, including disconnecting listeners and blocking IP addresses.
11. SERVICE AVAILABILITY
INDIE X FM strives to maintain reliable and continuous access to its Services but does not guarantee that the website or audio streams will always be available, uninterrupted, or error-free.
The Services may occasionally be unavailable because of maintenance, technical problems, server or network issues, upgrades, outages, equipment failures, or other circumstances.
INDIE X FM may perform maintenance, make technical changes, modify its streaming infrastructure, or temporarily suspend portions of the Services when necessary.
12. CHANGES TO THE SERVICES
INDIE X FM may change its programming, musical format, stream availability, website features, listening limits, submission procedures, merchandise offerings, or other aspects of the Services at any time.
INDIE X FM may also update these Terms from time to time.
When the Terms are updated, the revised version will be posted on the INDIE X FM website with an updated “Last Updated” date.
Your continued use of the Services after updated Terms are posted constitutes your acceptance of the revised Terms.
13. ENFORCEMENT
INDIE X FM reserves the right to enforce these Terms in whatever manner it reasonably determines is necessary to protect the station, its listeners, its streaming infrastructure, and its Services.

INDIE X FM is not required to provide advance notice before taking action against activity that violates these Terms or threatens the operation, security, or availability of the Services.
14. ACCEPTANCE OF THESE TERMS
By accessing or using INDIE X FM, you acknowledge that you have read, understood, and agreed to these Terms of Service.
If you do not agree to these Terms, you must discontinue use of the INDIE X FM Services.
